What is the minimum requirement for establishing order in societies in Islam’s view? In other words, what is the extent of order without which the societies would be entangled in disorder and decline?
“Allah’s right” and “peole’s rights” are among terminologies of Islamic law. The former is related to the public good and ensures the social order and discipline, and the latter speaks of the individuals’ good. In the Shiite penal law and jurisprudence, the ten limits of Allah’s right (i.e. the ten legal punushments) have been mentioned. These ensure the protection of religion, reason, lives, properties and reputation of the people. In Islamic teachings, observing these legal punishments are the minimum requirements for establishing order in any societies. In that case, it is expected that the intensity of the punishment conforms with the effects of the actions in society. Here, we have compared two of the legal punishments.
