The defensive war, however, is considered as an agreed upon issue. The traditionalists and the modernists do not believe in initial jihad, while the well-known Shiite scholars maintain that the initial jihad is specified to the time of the Infallibles' presence. Some believe in the necessity of the initial jihad in the Occultation Period. Martyr Mutahhari gives a broad explanation of defense (of monotheism), which includes the initial jihad – even in the Occultation Period. Some others such as Ayatollah Khouʾi, while not accepting the theory of '<em>Wilayat Faqih</em>' (i.e. the jurist's authority) and Islamic state, believe in initial jihad in the major Occultation Period. According to the 'confluence theory', waging war against the infidel countries that do not intend to fight against the Islamic state (the instance of initial jihad) is opposing to the independent reason. The independent reason negates the initial jihad in its common meaning. Indeed, the initial jihad in the modern age is negated. جهاد در فقه به دو نوع جهاد ابتدایی و جهاد دفاعی تقسیم می شود. جهاد ابتدایی، به معنای اعلام جنگ علیه کفار پس از اصل دعوت، در طول تاریخ اندیشه سیاسی اسلامی- اعم از شیعه و سنی- معرکه آرا بوده است؛ در حالی که جهاد دفاعی متفق علیه تلقی می‌شود. سنت‌گرایان (که باید ایشان را از علمای سنتی متفاوت دانست) و تجددگرایان به جهاد ابتدایی باور ندارند. در حالی که مشهور علمای شیعه جهاد ابتدایی را مختص به زمان حضور معصوم (ع) می‌دانند، برخی به ضرورت جهاد ابتدایی در زمان غیبت معتقدند. شهید مطهری تعبیر موسعی از دفاع (از توحید) به دست می‌دهد که حتی جهاد ابتدایی (حتی در زمان غیبت) را نیز شامل می‌شود. برخی نیز همچون آیت‌الله خویی هرچند به نظریه ولایت فقیه و حکومت اسلامی معتقد نیستند، اما به جهاد ابتدایی در زمان غیبت کبری باور دارند. بر اساس نظریه همروی، جنگ علیه کشورهای کافری که قصد جنگ با دولت اسلامی ندارند (مصداق جهاد ابتدایی) خلاف حکم عقل مستقل است. عقل مستقل جهاد ابتدایی به معنای مشهور را نفی می‌کند. در واقع، موضوع جهاد ابتدایی در دوران مدرن منتفی است.اگر، به فرض محال، مکلف به شروع جهاد به شکل ابتدایی باشیم، قراردادهای بین‌المللی تحدید کننده مسئولیت-های فراملی دولت اسلامی تلقی می‌شود. https://www.shiitestudies.com/article_249551_80d5fd80c99da030fbcaa010e968404a.pdf
