It was just in the recent era after the compilation of new constitution in 1382 SH (2003) that a window of hope was opened to that ethnic and religious minority. The question in the present inquiry is posed as follows: "how much political toleration has been inserted in the new constitution of Afghanistan compared to former constitutions and what was its role in ensuring the rights of the Afghan Shiites?" To answer this question, the hypothesis is posed as follows: "The new constitution of Afghanistan has considerable theoretical capacities in regard with political toleration, and one can explore various parts of it to find that it has the capacity to discover and extract the rights of the Shiite minority as well." This article aims at explaining and analyzing the theoretical aspect of political toleration in the new constitution of Afghanistan and its role in ensuring the rights of the Shiites. However, it must be noted that, unfortunately, enforcing that article of law is far from the existing reality.  حقوق شیعیان افغانستان به‌عنوان بخش قابل‌توجهی از شهروندان این سرزمین با ویژگی‌های هویتی و فرهنگی خاص، همواره در طول تاریخ نادیده گرفته شده و تنها در دوره اخیر پس از تدوین قانون اساسی جدید در سال 1382 شمسی روزنه‌ای فراروی این اقلیت قومی و مذهبی گشوده شده است. پرسش جستار حاضر آن است که تساهل سیاسی در قانون اساسی جدید افغانستان، در مقایسه با قوانین اساسی گذشته این کشور، به چه میزان گنجانده و رعایت شده و هچنین چه نقشی در تأمین حقوق شیعیان ایفا کرده است؟ در پاسخ به این پرسش، فرضیه‌ی این نوشتارآن است که قانون اساسی جدید افغانستان دارای ظرفیت‌های نظری قابل‌توجهی در زمینه تساهل سیاسی می‌باشد و با واکاوی در مواد گوناگون این قانون نشان می‌دهد که به لحاظ نظری ظرفیت کشف و استخراج حقوق اقلیت شیعیان نیز در آن وجود دارد. این نوشتار عهده‌دار تبیین و تحلیل وجهِ نظری تساهل سیاسی در قانون اساسی جدید و نقش آن در تأمین حقوق شیعیان است. اما با تاسف اجرای این اصل در عمل در مقایسه با واقعیت موجود فاصله زیادی دارد که لازم است مقتضیات، موانع و راهکارهای عملیِ تأمین حقوق شیعیان به شکل جداگانه و در پژوهشی مستقل بررسی شود. https://www.shiitestudies.com/article_248862_1bae4b2917447caea079be0a89537748.pdf
