Weighing the Fatwas of the Faqihs against people's reason and common sense, they could fall into three categories: the Fatwas that conform to both the rational approaches of the past time and today, the Fatwas that conform to the rational approach of the past time, and the one's that conform to today's rational approach. Considering the examples of these categories and their differences, we should find out which one is more in line with God's intentions. Based on two reasons, it appears that the Fatwa's which are conforming to the rational approach of today are more closely in line with God's intentions. First, because some of the sources from which the non-worshiping Fatwas are derived were in agreement with the special conditions at the time of the outbreak of religion. And second, the Faqihs must take into consideration people's common understanding of God's words. Understanding the scriptures and religious traditions does not belong to a certain group of people. The Faqih cannot ascribe a Fatwa to the religion if most people cannot ascribe that to the All-wise God. The role of people in understanding religious words might discredit the understanding of Faqihs and result in the ambiguity of those words. فقها در میان عقلا هستند و باید این آمادگی را داشته باشند که سخنشان مورد ارزیابی آنان قرار گیرد. فتواهای فقها را با این ارزیابی عقلایی می‌‌توان سه قسم کرد: فتواهای منطبق با رویکرد عقلایی عصر قدیم و جدید، فتواهای منطبق با رویکرد عقلایی قدیم، و فتواهای منطبق با رویکرد عقلایی جدید. بیش از نود فتوا و بیست قاعده فقهی با رویکرد عقلایی همه اعصار منطبق است. فتواهایی که بیشتر با رویکرد عقلایی عصر قدیم یا جدید منطبق است در حوزه حقوق کودک، زن، کافر، مالی و معنوی و فتواهای موافق با احتیاط یا تسهیل و در حوزه هنر،‌ دادرسی، نهی از منکر، مجازات ها و دیه قتل خطایی یافت می شود و با هم قابل مقایسه است. با توجه به نمونه‌هایی از این فتواها و تفاوت آن‌ها، به روش توصیفی-تحلیلی می‌‌توان گفت: فتواهای منطبق با رویکرد عقلایی زمانه با اطمینان بیشتر منطبق با مقصود شارع است؛ زیرا دست‌کم بعضی از منابع فتواهای غیر‌عبادی، متناسب با مقتضیات عصر شارع و مقید به رواج عرفی است و با تغییر آن اقتضاها، فتواهای منطبق با رویکرد عقلایی عصر قدیم نیز تغییر می‌کند. به ‌علاوه، توجه به نقش عقلا در فهم ظواهر الفاظ چه بسا موجب شود بعضی از الفاظ شارع در معنایی که بعضی از فقها فهمیده‌اند و منطبق با همان رویکرد است ظهور نداشته باشد و مجمل شود، که تفسیرش را باید به اهل بیت واگذار کرد. https://www.shiitestudies.com/article_248861_4fe9171152b49b795e2f9340e6e48fb6.pdf
